The Freedom of Information Act 2000 - Basic Provisions and Useful Cases

The Freedom of Information Act 2000 (the Act’) and the Environmental Information Regulations 2004 (the EIR’) have created a small number of cases that have made significant jurisprudence creating onerous new requirements for Local Government. 2. The full provisions of the Freedom of Information Act 2000 came into force for all Public Authorities in January 2005. Local Government has been preparing for full implementation for a number of years certainly as long ago as February 2003 when Public Authorities were required to make information available through their “Publication Schemes”. However, full implementation and making assessments as to how the Act and its provisions should be interpreted, has brought with it a whole host of potential legal pitfalls. 3. Two codes of practice have been created under the Act which will be of help to public authorities in meeting their new responsibilities. It will be important to follow both the letter and spirit of the statutory codes of practice pursuant to sections 45 and 46 of the Act so as to avoid costly litigation before the Information Commissioner and/or the Information Tribunal. 4. The Access Code gives the skeletal framework for compliance, but in an area of law that is largely untested in the English courts, making sensible and informed decisions will be of paramount importance. 5. Exemptions from disclosing information include certain information relating to national security, information that would prejudice international relations, commercially sensitive information, and confidential information. Commercially sensitive information has already cause litigation in the early stages of implementation of the Act. This will affect Local Authorities’ ability to tender for work. Important cases 6. In John Connor Press Associates v Information Commissioner EA/2005/0005 (25 January 2006) a request was made by John Connor Press Associates to the National Maritime Museum in relation to payments made to an artist for work commissioned by the museum. The Commissioner held that: the museum was involved in active negotiations with another artist that the premature release of the details of the financial arrangements between the museum and the artist would prejudice the museum’s bargaining position in these negotiations. the commercial interests exemption (s.43(2)) applied. that the public interest in withholding the information at the time outweighed the public interest in disclosing it. 7. The decision was appealed to the Information Tribunal. The Tribunal considered the ambit of “likely to prejudice” in s.43(2) and held that: “The question we have to answer in relation to the first ground of appeal is whether disclosure of the particular information withheld . . . would have been “likely” to cause such prejudice to the [museum]. We interpret the expression “likely to prejudice” as meaning that the chance of prejudice being suffered should be more than a hypothetical or remote possibility; there must have been a real and significant risk. We draw support for that view from the words of Mr Justice Munby in R (on the application of Lord) v Secretary of State for the Home Office [2003] EWHC 2073 (Admin), a case in which the same expression fell to be construed under the Data Protection Act 1998. 8. The Tribunal also rejected a submission on behalf of the Information Commissioner that its jurisdiction under s.58 of the Act was limited to reviewing his decision on a public law judicial review basis. 9. Applying that test, the Tribunal found that the threshold of “likely to prejudice” had not been met on the basis that: a considerable amount of information had been disclosed by the museum which would have been of use to those with whom the museum was engaged in negotiations. some details of the contract with had already been disclosed. The works of art of the two artists were so different that they could not be used as comparables for purposes of a negotiation. 10. In Harper v Information Commissioner EA/2005/0001 20/11/05 the Applicant made a FOIA request of the Royal Mail as to whether there had been requests for access to his personal file. The request was declined on the basis that that Royal Mail did not hold the record of the information asked for. The Commissioner accepted that Royal Mail did not hold the information. However, he found that the response was not sent within the 20 day time limit. 11. The Applicant appealed to the Information Tribunal. The Tribunal upheld the Commissioner’s decision, but went on to give some helpful guidance. The Tribunal considered that it was plain from the wording of s.1(4) that information can be held at one time, but not be held at the time that a request is received. It gave as an example of a lawful deletion a computer database which is completely erased every six months. It found that, if a request is made on 1 January, and the 6-monthly deletion happened on 10 January, with the time for compliance expiring in late January, it “is possible to take account of that deletion.” Conversely, a conscious decision to delete relevant information upon receiving a request would “not be in the ordinary course of business and would be unlawful.” 12. The Tribunal then considered whether it could be said that a public authority still “held” information which had been deleted from computer records. The Tribunal noted that most modern computer systems in fact did not actually “delete” information. The Tribunal gave practical guidance as to how authorities should attempt to recover data taking note of the following: the “restore” function in Windows. the use of “backup” tapes. the possibility of using “un-delete” or “recovery” software. 13. It was further held that: “The extent of the measures that could reasonably be taken by a Public Authority to recover deleted data will be a matter of fact and degree in each individual case. By Lynne Suzanne A simple shopping expedition to buy new clothes can become a daunting experience when you’ve lost your income through redundancy. Suddenly, “luxuries” like family holidays or a new car seem things of the past. I understand that feeling only too well. It happened to me some years ago. As if that wasn’t enough, my husband was also made redundant at the same time. Then a newspaper article changed my life… The article featured ordinary people, like me and you. I read how they enjoyed holidays to exotic locations, drove gleaming new cars and showered their family and friends with exciting goodies - all for free. Intrigued, I read on. Thinking there must be a catch somewhere! All these “compers” had one thing in common - they won prizes. Cars. Holidays. Landscaped gardens. Entertainment systems. Computers, toys and games for their kids. Luxury kitchens. Even a house. You name it. They won it. Normally, I’d read an article and forget it. But with teenage daughter needing new trainers and time on my hands, apart from seemingly endless job hunting, what had I to lose? A prize crossword in a high street chain store caught my eye. Completed, I sent it on its way and forgot all about it. Three weeks later the postman brought me a long white envelope. “Congratulations…,” I read, “you’ve won a small gift voucher.” At that moment I realized there wasn’t a catch. Ordinary people like you and me could, and did, win competition prizes. A prize draw on a bookmark in the local bookshop. Instead of bags of shopping I came back laden with entry forms, all shapes and sizes. Sitting in the library, wading through an encyclopedia to answer some of the competition questions, I realized what a challenging and fun pastime I’d discovered. And one that was only as expensive as I wanted it to be. Quickly discovering that prize draws were free to enter, all it cost was a postcard and stamp and not even that when you were allowed to drop your entry form into the free prize in-store posting box. Those competitions where you were asked to complete a tiebreaker sentence, such as: “I want to win a car with store because…” usually asked you to attach a qualifying till receipt, I noted. Avoiding expensive “qualifiers”, it was easy to switch buying habits. For instance, instead of your normal brand of soap powder, you simply bought the brand which was running a competition. You kept your till receipt and enclosed it with your entry as proof of purchase or “qualifier” as it was known. Thrilled was an understatement, when a store manager phoned to say I’d won first prize in their free to enter contest. A new wardrobe of clothes. My kids were delighted. Hubby and I took them to the store. I could hardly believe it when, laden with jeans, trousers, T-shirts, fashionable shirts and trainers, the manager accompanied us to a check out. It was like meeting Santa Claus in a suit. He totted up the bill to the amount of our prize win, thanked us for entering their competition and smilingly escorted us to the door before waving us a cheery good-buy! Although unsuccessful at finding new employment, despite scouring job advertisements and completing application forms, my new pastime of “comping” was keeping my brain active as well as changing our shopping and eating habits. Instead of window shopping, knowing we couldn’t afford to buy expensive goodies and luxuries, shopping became fun. Often the only thing I’d come back with from an afternoon of shopping, was a pile of entry forms! The competition tasks were varied, challenging and fun as family general knowledge improved by leaps and bounds. The reference library became a second home. Our diet changed according to qualifying till receipts. “Tonight,” I’d tell my family, “we’re having pizza - to try and win an Italian holiday. Served with tomato salad - to win a holiday in the Canaries. Followed by apples - to win a healthy break in France. Oh, and as a treat, you can have a chocolate - to win a Valentine’s cruise!” “Just remember I need the wrapper!” Within six months of discovering this new pastime, I won a family holiday in Devon, a TV, video recorder and lots of welcome runners-up prizes like bottles of wine, spirits, leather handbag, a watch, camera and shopping vouchers. Then came a worrying time followed by an exciting ten days. On Christmas eve my daughter was rushed to hospital with suspected appendicitis. Whilst in the hospital, we watched Del Boy and Rodney from “Only Fools and Horses” in The Everglades and wished we too, could take an airboat ride just like Del and Rodney. The lady in the next bed passed her magazine to my daughter. Inside was a tiebreaker slogan competition to win a healthy weekend break. Ten Tips for Your New Year’s Job Search

By Liz Ryan It’s a new year - and lots of people are thinking that maybe 2006 will be The Year of the New Job. If that describes you, then you’ll want to start planning for your big exodus. But don’t start strewing resumes across the landscape before taking care of a few getting-going items, described below. If you’re thinking about buying some spiffy new interviewing duds, get out to the stores now before the January sales are over! Good luck, and happy job-hunting… Starting a New-Year Job Search 1) GET YOUR RESUME READY That means on paper, on-line, and plain text (for inclusion in attachments). It means one-page and concise, spell-checked, and reviewed by someone who can give you great feedback on the content and the layout. These days, cool colors, marbled textures and funky typefaces are out. Clean, crisp and confident is the watchword. 2) GET A GROWN-UP EMAIL ADDRESS Hotmail, MSN and Yahoo email addresses aren’t suitable for a job seeker because of throughput issues and buffer size. Also, your “SailingGirl@qwest.com” is not a professional email address. Give yourself an advantage and use an adult email address on all job-related correspondence. Make sure this email address is on your resume and that all your friends have it, for use when they’re making introductions between you and possible job-search contacts. 3) CHECK YOUR PHONE MESSAGE CAPABILITIES Figure out how to collect messages remotely if you don’t already know. Get rid of the cute kid message or the clever one that impresses your college friends. If the home phone machine isn’t reliable, get a separate number for your job search. 4) GET JOB-SEARCH BUSINESS CARDS Even if you’re already employed, go to www.vistaprint.com and get free business cards (no kittens or hot-air balloons) just for use in your job search. Include the position you’re looking for, three bullet points about your skills and education, and phone and email contact information. 5) GO ONLINE Get on networking sites like LinkedIn (www.linkedin.com) and WorldWIT, the free email discussion network for professional women (but men are welcome, too - full disclosure, I helped to start the group) to get your online networking rolling! 6) USE YOUR ALUM CONNECTIONS Even if you graduated from school twenty years ago, your alumni network is a powerful tool that you shouldn’t underestimate. Many schools have databases of grads that you can search for people in companies or industries you’re interested in - then pick up the phone and call them! 7) GET OUT THERE Go to at least one face to face networking event a week. Use Google or your daily paper to learn about them - bring your job-hunting business cards (not your resume) and start chatting! Practice starting conversations and sustaining them, focusing on the other person. If it’s appropriate, within a few minutes you will have the opportunity to describe your own situation: “I’m a ten-year marketing professional, and right now I’m looking for my next opportunity.” 8) GET YOUR PITCH DOWN Your pitch should take two forms: a verbal 20-second introduction, and an Objective statement on your resume. What are you good at? What have you done? Where have you worked? What do you want to do next? When people ask you “What sort of job are you looking for?” you want to be able to quickly and enthusiastically describe your ideal situation. 9) TELL EVERYONE YOU ARE LOOKING Everyone except your boss, that is - if you’re already employed. Tell your college friends, your neighbors, and all the people you’ve ever worked with whom you’re still in touch. People at your kids’ school, people at your gym. Your job search knows no boundaries - networking is THE best way to get a new position. 10) CALL ON YOUR NETWORK Create a great “here’s-what-I’m-looking-for” email message, and send it (bcc:ing everyone on the list) to everyone in your Address Book (everyone except people who might rat you out to your boss, if you’re currently employed). Ask them to keep your job search in mind during their New Year networking - and offer to do THEM a favor, too - reciprocity is essential! The New Year is a great time to jump into a job search. And after the New year, companies are hiring. Get out there and look! Are You Codependent or Independent?

By Brian Maloney Why is it that depending on others to fulfill our self worth isa concept that we all can relate to? Sacrificing what ourthoughts, emotions, decisions, and likes or dislikes are, forthe betterment of someone elses. It is as if depending on the other person who you hold sohigh is more fulfilling then standing alone, independent ofthe other. Its root resides in a past when a person didntrealize they really had wings that could fly. Therefore, forfear of abandonment, they suppressed their own self worth,avoided confrontation, and then continued to please whothey were dependent upon. In contrast, the counterdependent person who has someonecodependent towards them, is pretending that they dontneed anyone else and have concluded that people only needthem. Both codependency and counterdependency are an internaldefense systems that shield and protect from past woundsof abandonment. They both are dysfunctional and lead thecodependent person down a tattered road of unfulfillmentand eventually depression. Perhaps, it could be said that all of us are, to some degree,dependent upon others because, after all, we are socialcreatures who inevitably need each other in some capacity. However, when it saps your very core of enjoying the giftof life God gave you, then the sun never rises and thedarkness only gets darker. We came into this world alone and we will also leave thatway! Inner strength comes from a true respect and love foryourself, no matter what the situation or condition is. Although, deep within many of our wounded souls, thatlove is not strong and therefore self respect is not properlyattained. This is where your deep-seated self-worth is obtained andhow you perceive yourself. In addition, it is the weakenedaura you emit to others see you that is not totally erect, butsomewhat wilted. Many of our true societal problems, whether they areinsecurity, control issues, codependency, addictions,manipulative personality disorder, seclusion, or simpleanger, stemmed from a lack of self love, self worth, andself respect.Hence, people replace one problem for the another! If you are lonely inside and do not feel as though you canlove the real you, then any and all subsequent relationshipswill feel that same inner turmoil until your inside is trulyloved! These social problems listed above can intertwine,commingle and cross each others boundaries in a veryinsidious manner. There is not one issue more serious than the other, they aremore or less on an equal plane and being dependent onanother, is certainly no exception. By not allowing ones self-worth to be determined byanothers perceptions, by not feeling that being loved byanother is conditional on living up to the expectations ofothers, or merely pleasing them, is absolutely critical tohealthy functioning! Taking full accountability for the way you feel instead ofothers making that discerning determination allows you tobe self dependent, kicks out the crutch, and makes youstand alone. As scary as that may seem to some, it is by far the best wayto perceive your self-worth. Trusting that you can ownyour own emotions, whether they are anger, happiness,setting boundaries, or leaving, is how we can come to theserene life we always dreamed of as a child. These decisions and self-adjustments for the better can bemade!
